General Terms and Conditions

1. Scope of Application These General Terms and Conditions (“Terms”) apply to all contracts, deliveries, and services provided by Airdome (“Seller”) to its customers (“Buyer”). By placing an order, the Buyer agrees to these Terms.

2. Offers and Conclusion of Contract 2.1. All offers made by the Seller are non-binding and subject to change until a formal order confirmation is issued. 2.2. A contract is concluded when the Seller confirms the Buyer’s order in writing or when the Buyer makes full payment.

3. Prices and Payment Terms 3.1. All prices are in Euros and exclude applicable taxes and shipping costs unless stated otherwise. 3.2. Payment must be made in full before production and delivery commence. 3.3. We do not offer cash on delivery; orders will only be processed after payment confirmation. 3.4. In the case of late payments, the Seller reserves the right to charge statutory interest and withhold delivery until full payment is received.

4. Production and Customization 4.1. Since all products are custom-made according to the Buyer’s specifications, once production has started, cancellation is no longer possible. 4.2. The Buyer is responsible for providing correct artwork, specifications, and approvals before production begins.

5. Delivery and Risk Transfer 5.1. Delivery times provided are estimates and not binding. Delays due to force majeure, supplier issues, or unforeseen circumstances do not entitle the Buyer to claim compensation. 5.2. The risk of damage or loss transfers to the Buyer once the goods have left the Seller’s premises or upon handover to the shipping provider.

6. Warranty and Claims 6.1. The Seller provides a 5-year warranty on manufacturing defects. 6.2. The warranty does not cover normal wear and tear, improper handling, unauthorized modifications, or external damage caused by weather conditions, misuse, or third parties. 6.3. Any claims for defects must be reported within 7 days of receiving the goods. The Seller has the right to inspect and determine whether repair, replacement, or compensation is applicable.

7. Returns and Refunds 7.1. Due to the nature of custom-made products, returns and refunds are generally not accepted unless the product is defective. 7.2. If a refund is granted under exceptional circumstances, it will be processed after the returned item has been inspected.

8. Liability 8.1. The Seller is not liable for indirect damages, loss of profit, or consequential damages arising from the use of its products. 8.2. In any case, the Seller’s liability is limited to the value of the purchased product.

9. Intellectual Property 9.1. The Seller retains all intellectual property rights over designs, templates, and concepts unless explicitly transferred in writing. 9.2. The Buyer ensures that all artwork or logos provided do not infringe any third-party rights.

10. Governing Law and Jurisdiction 10.1. These Terms are governed by the laws of the Netherlands. 10.2. Any disputes arising from these Terms will be settled in the competent courts of the competent courts of the Netherlands.

11. Final Provisions 11.1. If any provision of these Terms is deemed invalid or unenforceable, the remaining provisions remain in full force. 11.2. The Seller reserves the right to modify these Terms at any time, with updated versions published on its website.
